Why the need for an Ellis County and/or DFW Law Enforcement Database of every commissioned officer? You can thank the Combine, Texas Police Department's false accusations and false imprisonment of me last fall for the inspiration to devote an entire Web site to making sure that every bit of information on every commissioned law enforcement officer is made to the public.

Waxahachie Sex Crime Ring | Big Name People, Media Hiding Crimes

There was a town where prominent people -- including the publisher of the Establishment newspaper -- covered up for some of the worst crimes involving children. No one believed the victims. The public rallied around these individuals who were prominent in the community, who ran the Boys/Girls Club, who knew U.S. presidents on a first name basis, who even sang the national anthem at the Dallas Republican Party convention. One man, a prominent lawyer and also a state lawmaker, took the allegations and investigated them, up until the entire operation came crashing down...and several people ended up dead, or in prison, or both.

Now, in Waxahachie, Texas, we have a similar situation. There is a crime ring so big that it is being covered up by the big political Establishment newspaper (the Waxahachie Daily Light) and includes the most prominent individuals in the county, and in the community. Those in the know call it "the circle." Much like the circle that encompasses our county in the form of the old SuperCollider, this circle is a demonic, Satanic, from-the-depths-of-Hell sinister plot to cover up for the worst crimes against children since The Franklin Cover-Up.

My stories and investigations into the local Child Protective Services (CPS) ripping families apart are nothing compared to this...but those CPS stories on top of each other have stacked into one gigantic piece of this child sex ring pie. The other pieces include how the WDL is covering up for these crimes. The other piece is how the Sheriff's Office, the Waxahachie PD, and the biggest banker in the county is helping cover up for these crimes.

Judges, lawyers and other prominent individuals were busted by the FBI in the late 80s, early 90s for being implicated in drug-running operations. Not a word was reported, but everyone involved got away scot-free.

Today, I had the pleasure to meet Tamara Yarbrough in Waxahachie, and came away sickened, but also full of confirmations as to why I am in Ellis County, and why The Ellis County Observer is located here, and why The Ellis County Press was originally started out to be placed here.

Tamara Yarbrough has a rap sheet. A fairly lengthy, controversial one. That is not an untrue statement.

But she has alleged, and I have assisted in linking, the worst crimes in our county, mostly occurring in Waxahachie. Within "the circle."

Why else would the WDL cover up for, say, the Dr. Chitale crimes? Chitale was a doctor in Ennis Regional Medical Center. He sedated patients as he molested them. This was covered up because at the time, Ennis Police were distracted by certain women-folk, including JoAnn Livingston of the WDL, who reportedly was screwing Lt. Ron Roark. This was kept hush-hush until the Dallas Morning News (excuse me, until I and The Dallas Morning News) blew a hole in the story. Livingston later apologized to Chitale's victims because she couldn't/wouldn't report on what was going on.

Why else would the WDL and law enforcement cover up for (Google the words in bold) Judge Al Scoggins and Karen Weaver, not only their affair, but Karen Weaver's child molestation against four of her grandchildren?

Why else would the WDL and law enforcement cover up for Sara Ruth Spector's CPS horror trail, and CPS offices in Waxahachie and Ennis snatching kids to put them with family members with long, lengthy drug abuses? Livingston and Spector are friends.

Why else would CPS lose a civil trial (jury trial) and then counter it with a district attorney-led criminal case, only to then be drowned again by a jury? Same family, two different venues and two similar outcomes: not guilty. Livingston and the prosecutors are best friends.

Why else would the Waxahachie PD allow their patrol supervisor, Lt. Billie Wiggins Pendleton, stay employed when she clearly had an affair with the former police chief Ted Garber and his daughter? She's an admitted psychopath, according to transcripts in the Robert Trevino Case.

So, back to Tamara Yarbrough...

She has four children, ages 23 to 11. She is married to Kenneth Wayne Yarbrough, who owns a roofing company and who is good friends with CNB Texas' Mark Singleton, a Waxahachie councilman. He also did work for the lady who owned Lynn's Check Cashing; He also knows and is friends with the Crownovers. He's friends with Joe Rust, the prominent real estate king. Rust even became a character witness for Kenneth Wayne Yarbrough during a divorce proceeding before Judge Al Scoggins. Kenneth Wayne wants to divorce Tamara for a few reasons...let's dive into those:
1) Judge Gene Calvert issued a protective order against Kenneth Wayne Yarbrough on behalf of the 11-year-old daughter, the only daughter between Kenneth Wayne and Tamara, in October 2009;

2) Kenneth Wayne filed for divorce shortly after that, and was, shockingly, given custody of the 11-year-old daughter per a CPS intervention;

3) Tamara, remember, has a rap sheet. Probation for 10 years, etc. Nothing in the order I read today bars her from seeing her daughter, but Kenneth Wayne has blocked all communication and visitation access to her daughter. I'm guessing those friends in high places helped Kenneth Wayne out. This is strictly conjecture, but, as history proves in this county, it is precisely the reason this stuff happens...

4) Calvert issued out of his Court at Law No. 2 the protective order because of physical and emotional abuse;

5) One day, before the divorce proceedings and the subsequent CPS intervention, the little 11-year-old daughter came to Tamara to tell her, "I have something I need to tell you." Before the child could repeat a word, Tamara took her to Waxahachie PD and wanted the 11-year-old to tell the police the allegations, so as to not make it look like she was coaching her child. WPD said they'd call the Gingerbread Advocacy Center, an organization that supposedly assists victims of child sex abuse. One look at their board of directors will show a who's who list of those who are (some, not all) helping perpetuating the cover up against the crimes against kids: CPS; the District Attorney; the WDL, just to name a few...

6) Tamara Yarbrough never received a call. But her daughter met with the Dunaway Elementary principal and guidance counselor one day, and told them the allegations. I asked Tamara if her daughter ever told her...and Tamara said she didn't want to know for fear others would think she coached her child. The Dunaway officials, God bless them, called CPS and made the allegations from Tamara's daughter a "Priority No. 1," which is ISD lingo for "we have some serious problems here...and we need an investigation pronto."

7) Tamara later said that her daughter's journal confirmed that something had happened, while not going into detail (the journal was dated when her 11-year-old daughter wrote it, she said.)

8) Tamara and Kenneth Wayne Yarbrough have been married for 13 years.

9) Back in 1999, Kenneth Wayne Yarbrough's then-16-year-old son Heath Yarbrough was sentenced to prison for raping Tamara's then-3-year-old son. Heath allegedly raped him anally. It was later alleged that Heath himself was molested as a child. Heath is now out of prison for raping the 3-year-old (who is now 23.) There were other allegations: Kenneth Wayne's son, Heath, had exposed himself to neighbor girls and also allegedly raped another boy.

10) Tamara's now-21-year-old daughter alleged that Kenneth Wayne Yarbrough raped her as well. The allegations came out of Fort Worth, where the 21-year-old daughter lived at the time. Tamara said she didn't believe her daughter for fear that her daughter was making it up because "she was mad at me." The allegations - two to be exact - were made, and the Waxahachie police reportedly arrested Kenneth Wayne Yarbrough. Remember those high places with friends? One of them happened to be a guy named Dusty Autrey, the owner (co?) of Triple A (AAA) Bail Bonds in Waxahachie. Kenneth Wayne Yarbrough was given a "walk-through" and arraigned without even being present before an unknown judge. Funny how things like that work...

11) The IRS letter sent to Kenneth Wayne Yarbrough's friends the Crownovers is a telling document...in it, the IRS says the Social Security number Kenneth Wayne Yarbrough uses is invalid, and has been. The IRS told Tamara Yarbrough, "I've never seen anything like this in my 30 years of working for the IRS. It was as if he was never born, never existed."

12) Tamara said her and Kenneth Wayne never had a bank account, but CNB Texas' Mark Singleton would -- with Kenneth Wayne's signature reportedly -- give him a "$1 million line of credit" --- all this, Tamara says, with no bank account.

13) KCK Roofing is located at 815 Cantrell Street south of downtown Waxahachie. It's now part of Brogdon Roofing. Kenneth Wayne Yarbrough is friends with a James Brogdon. James Brogdon is the grandfather of a Jessica Brogdon, who Tamara said was in bed with Kenneth Wayne one day as she walked in (this was when Jessica was about 13 or 14.)...Kenneth Wayne Yarbrough was "butt naked" with the young Jessica. Kenneth Wayne told her he was off his medications (had Jessica been my young daughter, Kenneth Wayne would have had two bullets in his head.) That might have explained why he was naked, but why was a young girl whose grandfather is now business partners with Yarbrough in his bed? Tamara Yarbrough said she told Cindy Brogdon, Jessica's mother. (Cindy is married to Cecil, who is also part of, or the sole owner of, Brogdon Roofing.)

14) The Case Numbers, for those interested in researching more, in both the Calvert protective order and the Scoggins divorce proceeding are: 79.619-D (Scoggins-divorce/CPS) and 7956CCL (Calvert-protective order.)

15) About Tamara Yarbrough's arrest rap sheet. Again, this is not to be covered up, or ignored. But Tamara Yarbrough said she has been put in jail for months at a time, or on weekends, or periods of time and not been given the reasons she was in jail. She's been told of court hearings that take place without her knowledge.

Sound familiar, Ellis County?

There's a sex crime ring in Ellis County, Texas, and more importantly, in Waxahachie. There's an even larger underground Satanic cult --- the same cult that was linked to the killing of an undercover MIdlothian police officer in 1987 --- operating.

We call these principalities and powers that we wage war against, and obviously, with one click of a mouse and the typing of a few words and names, one can find out that there is a sinister Satanic, demonic imaginary crime scene tape circulating Waxahachie.

And at the top of it all is a Franklin Cover-Up type of operation, with members in the most prominent positions of "our community."

I fully expect to be sued for this article that will hit my newspapers, but now the burden of proof is going to be on those alleged to have taken part in these crimes. Of course, I will issue any and all responses to these allegations made by Tamara Yarbrough. I have offered in the past whole pages and whole forums for those who disagree with what is written on this site to have their say.

But let's not hold any punches: there's a reason why law enforcement, CPS, the media has all conglomerated to cover up for the worst crimes against kids in this county.

Those character witnesses to Kenneth Wayne Yarbrough ------------- alleged to have sodomized and raped little kids, as well as appearing naked in bed with a little girl -------------------- is another Who's Who list. Joe Rust. Rocky Stones (though he did not show up.) There are others...including the now 21-year-old daughter who said, "Mom needs to get help."

After reading this, we all need help. And we all need protection. Because Satan just got outed, and his powers and principalities and his agents who are covering up for these crimes are about to get judged. When I started The Ellis County Observer in October 2005, I told friends of mine, "God is going to bring judgment on Waxahachie."

Taxpayer-Funded Airport Manager Lied About Being 'Naval Aviator'

Taxpayers in Midlothian and Waxahachie continue to allow their city councils to babysit Mid-Way Regional Airport manager Andy Biery as he is once again shown to be lying about his military background (among other resume-padding items...such as prior airport management experience he never had.)

In any other case with any other person, lying about one's military background would be the death knell for (1) a political campaign for sure and (2) someone's career.




The Midlothian Chamber of Commerce, like past articles in the Waxahachie Daily Light, continue to repeat this disgrace. Now, Andy, what would Katy, Jack and Jett think about their dad being a pathological liar? Is this the truth you really want them to find out when they're old enough to research the Internet? "Mom, why is dad lying about his military service?" "Mom, why is dad all over the Internet and people saying bad things about him?"






Lies on top of lies on top of lies, Andy...pretty soon you're going to have to face the music.











As for Mark Singleton, Waxahachie's newest councilman, his campaign yard signs had "Accountability" plastered all over them. To whom, Mark? To what? Accountability to who, you? Mark Singleton has already worn out his term of office...I'll give him the benefit of the doubt, but I won't let that one-word on his campaign sign go unnoticed.






So far, the city councils and taxpayers in both towns are allowing a guy to lie about his military service. Pilots tell me he has mentioned his "naval aviator" experience numerous times. This is a lie. It is a disgrace, and those who really did serve in those capacities should not be insulted...






But hey, if that's what you want to tell Jack, Jett and Katy, then Andy, you have no conscience....no amount of Gospel singing and concerts will give you one, either.

Child Protective Services Atty Feared for Her Safety Due to The Ellis County Observer

Sara Ruth Spector, the former Child Protective Services attorney for County/District Atty Joe Grubbs, looked for employment elsewhere after she reportedly thought The Ellis County Observer was putting her safety and jeopardy in line. This came from the ex-Combine Police Dept. reserve officer John Allen "Jay" Hoskins yesterday (Hoskins had me thrown in jail for 12 days, and now there is a civil rights lawsuit at work; Hoskins and his chief both resigned after I walked out of jail a free man, all charges being rejected by Dallas County prosecutors):
Comal County Assistant District Attorney Sara SPECTOR contacted this agency, and stated that when she was an ADA in Ellis County within the past year, that DAUBEN posted that she needed to be the victim of “vigilante justice” for her involvement in a CPS case as an attorney for the State, and subsequently, MEISSNER began to place several phone calls to her. She stated she did not return them. SPECTOR stated she further feared for her safety, and immediately began pursuing jobs elsewhere after DAUBEN’S calls for “vigilante justice”.
LOL @ "vigilante justice." I guess if vigilante justice is whipping up parents, supporters, readers of the blog and lawyers to shape the public opinion against Spector, I'm "guilty" of making her leave Ellis County. Thank God, and good riddance. Sara Ruth Spector is a psychopath whose father and brother are both psychologists. She has no children. She has no husband, yet she thought she could bully her way into Court at Law No. 1 hearings and argue that fathers who were meth addicts and who never saw their kid were acceptable to take custody of them. She also called in a suicide attempt -- and I have that from the very dispatchers who took the call! Spector asked at least two times with me in the audience to have Court at Law No. 1 restrict, ban and gag any writings on the blogs and newspapers, at which point Judge Greg Wilhelm totally rejected.

Not everyone can be your friend, Sara...I know you benefitted by being friends with the Waxahachie Daily Light's JoAnn Livingston.

I was destroying CPS cases through this blog, and Sara Ruth Spector was the biggest "prize" ------ she didn't like the fact her cases were being tried in the press and on the blog, and more and more angry parents found out the truth, and more and more came out of the woodwork. I posted CPS employees' pay scales and resumes online (on this very blog) to give parents some ammo in dealing with these family-destroying tramps.
Vigilante justice, haha. I'm harmless as a gnat, people. Former "detective" Hoskins was so traumatized that I would create CrookedCombine.com and GypsyCopJay.com and issue editorial attacks on him that he had me thrown in jail for 12 days...at least when I was getting paid money to create those Web sites, I was utilizing them to publish the truth about him and others' records (much like he did with MichaelMeissner.com and The Bardwell Intruder.) Unlike JoAnn Livingston, I don't get paid not to report things...there's a market for the truth, is what I've always said.

I have SaraSpector.com too. Is that a crime? I was paid $25 to get SaraSpector.com. Does anyone want to start an "investigation" on me now for that? You people are comical...

I got rid of Sara Spector just like I got rid of a whole bunch of people in public office. This blog has taken all sorts of people on, and it has brought down a myriad of elected and appointed officials.

I don't need concoctions of violence to carry out my mission...I just need a pen, a keyboard, a digital camera and a newspaper, of which I am about to hold seven such papers in my portfolio.

Andy Biery has created a cesspool and one that city officials in Midlothian and Waxahachie continue to cover up for. The big word on Waxahachie Councilman Mark Singleton's yard signs this year was "accountability." I am going to make sure he eats that word every. Single. Day. I'm tired of you people ignoring the plight of the pilots at Mid-Way Regional Airport. You either flat-out ignore it or you attempt to cover it up and hope it just goes away...



It's hard to cover up any further the total sham lies that Andy Biery claims he was a "naval aviator." He was an E-4 and served four years in the military. He was nowhere near an airplane's cockpit. He continues to claim he was a naval aviator, just like he and the Waxahachie Daily Light have claimed and have not retracted the statements that he managed an airport. He never did that either.



To top it all off, the pilots have a mutiny on their hands with this Gospel-singing scam artist. He works for the public being paid by tax dollars and no one wants to shoulder "accountability" for this.

Court at Law No. 1 | Another Ellis County CPS Case, Another Bizarre Story

I thought my days of fighting off Child Protective Services problems were somewhat over with, but obviously, there are still demons in the pit I've got to expose...starting with Christine Williams' story that she told and re-told to me today in a sit-down interview:

-- Her daughter, Destiny Briggs, fought off a CPS attempt to take away her lovely daughter Aaliyah in Round 1 of a battle --- she later won full custody of the children. This first case involved Destiny living with a friend and her daughter, plus this friend's mother. The mother was reportedly an alcoholic and pill-popper who got angry with Destiny one day and left threatening voicemails on her phone that said something to the effect of, "I'll make sure you never see your kid again..."
-- During that first CPS battle, Destiny's little daughter was temporarily placed with a LaDonna Garrett and her husband. After the CPS situation was resolved and Destiny won full custody (Ellis County's jurisdiction was set because Destiny's friend lived in Waxahachie...and so the mom made accusations in Ellis County, hence CPS becoming involved -- and later, CPS lawyers rejected attempts to transfer the case to Tarrant County CPS officials.)

-- Bizarrely, this LaDonna Garrett had photos upon photos upon photos of cute little Aaliyah (such a pretty name) all over her house, but not a single one, according to Christine Williams, of her biological son.

-- It recently slipped out in Court at Law No. 1 (Judge Greg Wilhelm, R-Midlothian, presiding) between Destiny's lawyer and the baby's lawyer that LaDonna had made "hysterical" phone calls crying and wishing for the adoption of this baby Aaliyah.

-- Christine Williams and her daughter Destiny (mother of Aaliyah) have tried and tried to get Greg Wilhelm to stop this repeated call for mediation. He has ruled such mediation twice now, according to Christine. Judge Wilhelm has not heard all of the facts of this case as to why LaDonna Garrett is insisting on adopting the child (Aaliyah.)

Where it gets weird is that there is a motion for "temporary custody awaiting adoption" -- according to Christine Williams -- that LaDonna Garrett has got going in Court at Law No. 1. I'm sure there are many details left to flesh out in this ordeal, but Garrett has reportedly bragged about having many family members in law enforcement, including an extremely nice, cordial uncle who works at the Court at Law offices (or at least did when the offices were at the old Walmart building in Waxahachie.) Her Facebook friends page has a "Wilhelm" listed...though Christine Williams says she's unsure if there's any relation to the judge, but should this become an issue? We'll see...
Though Christine Williams says CPS is not involved in Round 2, I think they are...behind the scenes or what-not. CPS doesn't forget people who beat them...case in point: Mark Griffith's clients, the Daubitz family, defeated CPS in a civil case (jury trial) and in a subsequent criminal matter. CPS is the most unaccountable organization in Texas. It answers to no one other than juries, and still, that hasn't stopped them from enacting political revenge from prosecutors via their court-connections.

Again, there are many details to be fleshed out in the coming days...but right now, there are mediation hearings and Aaliyah's family does not want to give the child up for adoption to LaDonna Garrett, or to anyone.

How in the hell can a court set a motion for the adoption of a child even after Destiny Briggs was awarded full custody of the child in Round 1?

Does not make sense in the slightest...

The Court of Public Opinion is now in session. I'll be the judge, but I'll let the public opinion sway whichever way...I want justice to be done for little Aaliyah, and if there are any subversive tactics being used to steal a child away from a parent, they will have me to contend with.

Because my CPS record is spotless...to quote Mark Griffith:
"You are to journalism what I am to law."

Mid-Way Regional Airport | Pilots Revolt Over Andy Biery

Mid-Way Regional Airport manager Andy Biery is no stranger to critcism from this blog, or of public opinion in general. It's just a mystery why this son of a federal judge* has allowed to run roughshod over pilots, companies that do/did business with the airport and has allowed to escape scrutiny for padding his resume with things like, "I'm a Naval aviator" and "I have previous airport management experience." Both are lies. Both are not true. Both are made-up. Both would have resulted in someone in the private sector disgraced from their job.

Andy Biery is a problem and a liability at Mid-Way Regional Airport, and his coddlers and handlers known as the Mid-Way Regional Airport Board with Paula Baucum as the chair have allowed this guy to continue unabated.

Taxpayers from Midlothian and Waxahachie subsidize the airport -- and Biery's salary -- annually, so it's only fair that I remain a stick in the side of the airport, since ultimately, the accountability is a public street. If this were a private airport and a private situation, I probably wouldn't care as much. But we're talking millions of dollars in government contracts that may or may not have been signed to do work at the airport. We're talking about Biery pissing off TxDOT and others with his fees and hypocritical policy changes...like these:

Recently several long-time Midway Airport residents moved to Dallas Executive Airport. Now, instead of airplanes, the vacated hangars are housing recreational vehicles and at least one car.

The gentleman in the RV in Hangar B6 appears to be staying in it. At 11:00 PM his car was parked outside, the RV was inside the closed hangar with the RV's air conditioner running, the sides expanded and the shades drawn.

So, we've recently lost an active aerial advertising business and a corporate turbine aircraft and this is what we are replacing them with? What was the purpose of all the meetings were every detail of the new leases was explored and the rules were examined so thoroughly? My husband and I were just asked to sign new leases for the three flight school hangars. Each lease contains the statement ". . . the leased premises shall be used solely for the storage of airworthy aircraft . . . "  To whom do these rules apply?

Let's not stop there...what about the welding taking place around hangars and planes -- quite risky at a government airport. Surely there would be some sort of safety precautions taking place...or surely the "professionals" running the airport could get a handle on their poodle, Andy Biery. See, that's what Andy Biery has become, the poodle of the political establishment. No matter his lack of airport experience (anywhere, not in Arlington, not in Lancaster...) or the fact he was never a Naval aviator. Ever.



The safety of everyone at that airport has been blogged about before. The photo above is direct evidence that Andy Biery has no idea what he is doing...allowing welding to take place like this...I know if that were my plane and my hangar and my insurance company saw this, the risk level would skyrocket...



So, Waxahachie Councilman Mark Singleton, what's so great about Paula's leadership over the airport board with the scores of evidence to the contrary about this Andy "Poodle" Biery? How can one sit by as the house burns and say, "well the lawn is nice and pretty at least!"




Maybe it was the intention of those involved to make Biery get the needed licks...oh well, when Ennis breaks ground on their massive airport, I guess we could stuff balloons and RVs at Mid-Way.

Emergency Services District No. 4 | Dub Nowell on Monday Agenda

Our county commissioners can do no wrong by appointing former Red Oak fire chief Dub Nowell to the Emergency Services District No. 4 board of directors. He's on the agenda for Monday night's commissioners court meeting. He would bring an immense amount of experience to ESD No. 4.

Dalton Lott, Parkland Defend Breaking Open Meetings Act, Premature Birth Actions

Is this the same Dalton Lott who is the political equivalent to Tony Soprano in Duncanville (the chair of Pro-Dunc PAC)? The same Dalton Lott who oversees Parkland Hospital's quality and risk management committee, the very body that was featured in the Dallas Morning News Metro section today?

Parkland, a taxpayer-funded abyss of a hospital, is apparently not meeting World Health Organization standards of keeping premature babies warm enough after they are delivered via C-sections (I refuse to acknowledge the offensive term, "preemies" that the DMN refers to these living human beings as.)

Not that I'm a fan of subscribing to a world body known for implementing the actual AIDS virus in African nations or promoting the widespread use of lethal doses of poison in children's vaccines, or better yet, hyping up the very-real BS of the H1N1 fear-mongering.

But the open meetings violations are extremely clear, judging by the questions these Parkland executives and busybodies were asking in haste towards the DMN reporters. How arrogant! The public agenda, according to the DMN, never listed an executive session item, but after some scrutiny over the premature birth temperature issue, Parkland's board went behind closed doors for almost four hours.

If this Dalton Lott is the very Dalton Lott I think it is, he is helping assist Parkland in violating the Open Meetings Act.

Why is Land Linked to Jim Pitts Lower in Appraised Value Than Others' Land?

State Rep. Jim Pitts, R-Waxahachie, is looking into an issue I e-mailed him about last week regarding some land that his sister-in-law, Ellen Zinn, owns throughout Ellis County. Zinn's land, or much of it, is listed under a Pitts entity. My source for the packed packet envelope full of documents, maps and other information reports that the Ellis Central Appraisal District said due to Zinn owning 3,000 or more acres in Ellis County, her appraised values were lower...read the bottom of this report for Chief Appraiser Kathy Rodrigue's response to that....

Here is the response from Ellis Central Appraisal District Kathy Rodrigue as to why these discrepancies exist on Pitts-linked land.
This response is in reply for your request for comment. One of the characteristic of a property is its size and when valuing properties similar sized properties should be valued similarly taking into consideration any other differences in characteristics. State law requires, in the Texas Property Tax Code cpa.state.tx.us/taxinfo/proptax/96-297-09.pdf that:

§ 23.01. Appraisals Generally

Text of section effective Jan. 1, 2010. See, also, text of § 23.01 effective until Jan. 1, 2010.

(a) Except as otherwise provided by this chapter, all taxable property is appraised at its market value as of January 1.

(b) The market value of property shall be determined by the application of generally accepted appraisal methods and techniques. If the appraisal district determines the appraised value of a property using mass appraisal standards, the mass appraisal standards must comply with the Uniform Standards of Professional Appraisal Practice. The same or similar appraisal methods and techniques shall be used in appraising the same or similar kinds of property. However, each property shall be appraised based upon the individual characteristics that affect the property’s market value, and all available evidence that is specific to the value of the property shall be taken into account in determining the property’s market value.

Therefore, similar sized properties with similar characteristics in similar market areas should be valued similarly. Comparing a 150 acre tract to a 3,000 acre tract would be inappropriate because the size characteristic is dissimilar.  Comparing a 150 acre tract to other like sized acreages would be appropriate and is in compliance with the Uniform Standard of Professional Appraisal Practices (USPAP). There is no favorable treatment for ownership, it is a matter of recognizing property characteristics and how they affect the property’s market value. Our policy and administrative decisions are to comply with state law and USPAP.

Gun (Control) Free Zones? A Q&A w/a Local Police Chief Over ISD Gun Laws

Rather than wait until the print-edition of The Palmer Post is out, I thought this would be a good way to spark a discussion and get people's opinions...please specify if you do not want your answers included in the June 14 issue of the paper, though.
Palmer Police Chief John Zaidle Q&A: Gun Laws in School Zones

As a matter of public discourse, The Palmer Post publisher Joey G. Dauben proposed a question to both Palmer Police Chief John Zaidle and Palmer ISD. This question and answer interview is designed to spark independent thinking, judgment and public dialogue.

Question: Some guys at Lee's Gun Repair and I were discussing gun laws, and they brought up something that got me thinking...First, where do those PISD school zone zero-tolerance policies/laws/etc. stop? Do they extend to and over FM 813 or Jefferson Street or Dick Street, or is it just the property that PISD owns? Second, the item of discussion was that in theory, Palmer police could pull over a parent on the shoulder of say, 813, and spot a gun and therefore, the gun would be in violation of the zero-tolerance policy. Or if the police pulled over anyone and they were to drive onto school property in say, a parking lot, the theory went, the rifle in the back window could be in violation of the school zone policy. My intent with these questions is to clear up some of the "rumors" about the gun laws, and inform and educate the public as to what the zero-tolerance policy is on guns.

Chief Zaidle: As with so much of our body of laws, things are not very clear and can be quite confusing. Many times in my law enforcement duties, I am forced to make an educated guess as to what the law currently is, and advise individuals as best I can while trying to navigate them through the mine fields of American Laws. Why do you think we call the decisions of appellate courts "opinions"? Their opinion is not necessarily right, or better than mine or yours. It's just their opinion. Look at all the cases that get reversed; each and every one means that some judge was wrong about the law. Here is the state of things as of now: The Federal Gun Free School Zones Act was re-enacted a few years ago. This law makes it illegal to possess any gun with in 1000 feet of any piece of property that is used by a school. It is vague. Does it cover office space rented out in an office building by the administration of our local school district? What if they rent out a room in a nondescript building for monthly meetings of a school-sponsored activity group? What about home schools? It's all very messy and unclear and there are no easy answers. Until someone gets prosecuted and fights it will we get any judicial "opinions" on what is legal or not under this law. The stated exceptions are for guns possessed in your home, CHL's, and guns unloaded and locked in a container. One must also realize that federal laws are not often enforced. Many local police often will not alert federal authorities to violations of federal laws. Even when they do, the US Attorney's office, often does not trouble itself with prosecuting them. Remember, reliance upon police agencies (or even their attorneys') "opinions" on the law is NO defense if a court disagrees with that opinion. We are all presumed to "know the law" and ignorance thereof is no excuse. This doctrine worked fine in the days when laws were few and simple. Not so today. Not even lawyers and courts can agree on what the law is. As regards our state's 300 foot gun free school zone law, it applies only to handguns, and it excepts CHL's. So, possession of a handgun in your car as you drive to the gun range on a Saturday past an unmarked building where after-school activities are conducted on Wednesdays may still land you in jail and punishable for a felony. Not likely, but possible. Under the law as it is now, "premises" is defined to exclude driveways and parking lots. So a CHL can carry in those places. I hope this helps.

Since the liberal tramps in the Waxahachie Daily Light and other locations (mainly those of a liberal variety who have no grasp of what our Constitution means or says) are freaked out about this "militia" talk, I offer no response...I don't speak for anyone other than myself, but a militia is a completely voluntary, non-violent body of God-fearing people ---- armed to the teeth.

The Second Amendment, people, is to protect one against the government as a last option. That is precisely what it is there for. Go research it.

Exclusive: Ron Brown Paid Employee's Construction Firm $17,000+ for Asphalt Work

David M. Jeter owns J Brothers Construction, and he received a $17,535 payment for asphalt work on Sept. 11, 2009, according to the documents obtained from the Ellis County auditor and the Comptroller's Web site.







Precinct 4 Commissioner Ron Brown awarded Jeter the contract. Jeter works for the county in Precinct 4. In other words, Ron Brown's his boss.

No other media outlet has touched this...

I hope a tidal wave of pissed off taxpayers takes out the county's servers and the computer system in Precinct 4...but that's just wishful thinking on my part.
